i just updated to the latest cvs and i notice a build.bat file but it is looking for xbepatch.exe. i am wondering where this file comes from. it doesn't appear to be part of cvs nor vs.net or the xbox xdk...any hints?

this tool is to patch your xbe from debug to retail (nessecary for some older mod bioses to run the xbe). you can get the tool here.
